I have been getting calls from a collection agency about an old credit card debt. They call multiple times a day, sometimes as early as 7 AM. The last caller threatened that they would garnish my wages and even said they could have me arrested if I didn't pay immediately over the phone. This scared me, but something felt off.
After doing some research, I found out that a lot of what they said might be illegal. For one, I never received a written notice in the mail about this debt, which I guess they are supposed to send within 5 days of first contacting you. Also, I now know that in Ohio, they can't threaten wage garnishment unless they have actually sued me and gotten a court judgment first. The statute of limitations on this debt might have also passed, but I am not sure.
I contacted a consumer protection lawyer I found online, and they are reviewing my case for free. They said the repeated calls and threats could be violations of federal law, and I might be entitled to up to $1,000 in damages. They sent a cease and desist letter, and the calls have finally stopped for now. It feels good to have someone on my side who knows the Ohio laws. Has anyone else had a similar experience or hired a lawyer for this? I am curious to hear if it is worth pursuing.
